(hereinafter, “FLUZO” or the “Data Controller”) is the controller of the personal data obtained from users through their use of this website, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter, the “GDPR”), and Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter, the “LOPDGDD”).

The Data Controller may disclose your personal data to public authorities and government bodies solely where necessary to comply with applicable legal obligations.

In addition, the Data Controller works with certain external service providers who process your personal data on our behalf, such as:

• Providers of infrastructure and technology support services (including hosting, cloud storage, backup, security, identity management and systems support services).

The Data Controller applies strict criteria when selecting service providers in order to comply with its data protection obligations and enters into the corresponding Data Processing Agreement with them, in accordance with Article 28 of the GDPR.

In certain cases, FLUZO may transfer personal data to recipients located outside the European Economic Area. Where such transfers are made to countries that have not been recognised by the European Commission as providing an adequate level of protection, FLUZO will ensure that the appropriate safeguards required under applicable data protection legislation are adopted to legitimise the international transfer.

4. How long will we retain your personal data?

Your personal data will be retained for as long as strictly necessary to fulfil the purpose for which they were provided or collected. In this regard, the criteria used by the Data Controller to determine the retention periods for your personal data have been established in accordance with the requirements set out in applicable legislation, regulations and regulatory guidelines.

Accordingly, your personal data will be retained for as long as you maintain any contractual relationship with the Data Controller.

Once such relationship has ended, your personal data will be deleted once all necessary actions have been completed to manage and conclude any outstanding obligations between the parties, including all necessary administrative procedures during that period, except where you have expressly consented to receiving bulletins and newsletters from us, in which case your data will be retained until you object to such processing.

Notwithstanding the above, your personal data will be duly blocked and retained for as long as liabilities may arise from the performance of our contractual or pre-contractual relationship, as well as for compliance with other legal obligations incumbent upon the Data Controller.

In this regard, the Data Controller guarantees that it will not process such personal data unless necessary for the establishment, exercise or defence of legal claims, or where it is required to provide such data to public authorities, judges and courts during the applicable limitation period for your rights or legal obligations. Thereafter, your personal data will be deleted.

You may contact FLUZO at any time to exercise your rights of access, rectification, erasure, restriction of processing and objection, as well as your right to data portability and not to be subject to automated decision-making, and to withdraw your consent at any time, without affecting the lawfulness of processing based on consent prior to its withdrawal.
